On February 13, TheBlock reported that Cboe BZX Exchange submitted a revised proposal to allow 21Shares Core’s Ethereum ETF to be pledged, and is currently awaiting further action from the U.S. Securities and Exchange Commission (SEC). The document stated: “Based on discussions with the issuer, Cboe BZX proposed to amend some provisions of the Ethereum ETP Second Amendment to allow Ethereum held by the trust to participate in the pledge.”
The SEC approved the 21Shares Core Ethereum ETF last year (including BlackRock, Fidelity and other institutions approved at the same time), but several companies deleted the pledge clauses in the registration statement before approval. Former SEC Chairman Gary Gensler once said that proof-of-stake tokens are securities. However, the SEC is expected to be more friendly to encryption under the Trump administration, and has established a crypto working group to classify some tokens as “non-securities.”
